El argumento del tribunal y ahora del sentenciador fue que la FGR no acreditó que los fortuna implicados en este asunto fueran ilícitos, un requisito lícito para establecer la existencia del delito lavado.
Un sentenciador federal canceló ayer el proceso por delincuencia organizada y lavado de fortuna iniciado hace cuatro primaveras y medio a Juan Collado, por el caso de la operación cesión supuestamente simulada del edificio de Caja Autonomía en Querétaro.
Al estimar que los hechos imputados no constituyen delitos, Gustavo Aquiles Villaseñor, sentenciador de control del Centro de Jurisprudencia Penal Federal del Reclusorio Ártico, canceló el trámite del procedimiento, un falta que tiene género de sentencia absolutoria, informaron allegados al caso.
En una audiencia celebrada la mañana de ayer, el juez basó su resolución en la sentencia dictada en diciembre pasado por el Primer Tribunal Colegiado de Apelación en Materia Penal, que revocó una condena de 15 primaveras con 6 meses de prisión contra José Antonio Rico Rico, expresidente del Consejo de Dependencia de Caja Autonomía, y ordenó su exención.
El argumento del tribunal y ahora del sentenciador fue que la FGR no acreditó que los fortuna implicados en este asunto fueran ilícitos, un requisito lícito para establecer la existencia del delito lavado; por consecuencia, siquiera podía acreditarse la delincuencia organizada, pues este delito exige acreditar la existencia de un orden criminal que opera de guisa reiterada.
Indicaron que la causal invocada para la abolición del proceso es la prevista en la fracción II el artículo 327 del Código Doméstico de Procedimientos Penales, que señala que los hechos cometidos no constituyen delito.
Cerca de asegurar que el falta dictado en patrocinio de Collado aún no es definitivo porque todavía puede ser apelado por la FGR.
La audiencia de este miércoles fue solicitada por Collado desde hace unos días, luego de conocer los argumentos de la sentencia en patrocinio de Rico, quien quedó en exención el 29 de diciembre.
Este es el proceso por el que el abogado del expresidente Enrique Peña Nieto fue capturado el 9 de julio de 2019 en un restaurante de las Lomas de Chapultepec, en la Ciudad de México.
Es asimismo el caso por el que la FGR pidió imponerle una condena de 36 a 38 primaveras y medio de prisión y un plazo de 173 millones de pesos por concepto de reparación del daño.
A Collado se le implicó en este asunto porque cuando el 25 de marzo de 2015 fue adquirido el edificio sede de Caja Autonomía -ubicado en Querétaro-, se pagaron 173 millones 222 mil 400 pesos, de los cuales, 24 millones fueron transferidos al abogado, lo que hizo presumir a la FGR que la operación fue una simulación, es asegurar, una autocompra.
